The Promotion of Access to Information Act No. 2 of 2000, (“the Act”) came into operation on 23 November 2001.  Section 51 of the Act, in conjunction with section 17 of the Protection of Personal Information Act 4 of 2013 ("POPIA"), requires that we as a private body (as defined in the Act) compile a manual giving information to the public regarding the procedure to be followed in requesting information from Truworths Limited for the purpose of exercising or protecting rights including exercising its rights under section 23 and 24 of POPIA (this "Manual").

Truworths Limited (Registration Number 1940/013923/06) (“Truworths”) is a fashion retailer and the major subsidiary of Truworths International Limited (Registration Number 1944/017491/06), an investment holding company whose shares are listed on the JSE Securities Exchange (SA).  Truworths has the following operating South African subsidiary:

  1. The section 10 Guide on how to use the Act [Section 51(1)(b) of the Act]

The Act grants a requester access to records of a private body, if the record is required for the exercise or protection of any rights.  If a public body lodges a request, the public body must be acting in the public interest.

Requests in terms of the Act shall be made in accordance with the prescribed procedures at the rates provided.  The forms and tariff are dealt with in paragraphs 7 and 8 below of this Manual, in compliance with the Act.

Requesters are referred to the Guide (on how to use the Act) in terms of Section 10 of the Act which has been or will be compiled by the South African Human Rights Commission in terms of the Act, which will contain information for the purposes of exercising Constitutional Rights.

  1. The request procedures

Form of request:

 

    • If you wish to request access to any of the above categories of information, or exercise a right as regards personal information as provided for in section 23 and 24 of POPIA you are required to complete a request form as set out herein.  These forms are available from:
      • Our Information Officer (whose contact details are in section B of this manual);
      • The SAHRC website (www.sahrc.org.za);
      • The Department of Justice and Constitutional Development website (www.doj.gov.za).
    • There is a prescribed fee (payable in advance) for requesting and accessing information in terms of the Act.  Details of these fees are contained in the request form.
    • You may also be called upon to pay the additional fees prescribed by regulation for searching for and compiling the information which you have requested, including copying charges.

 

Fees:

A requester who seeks access to a record containing personal information about that requester is not required to pay the request fee. Every other requester, who is not a personal requester, must pay the required request fee:

This Manual provides for the following information as it relates to POPIA:

  1. Purposes of processing personal information by Truworths:

Customers:

  1. performing duties in pursuance of any agreement with customers;
  2. make, or assist in making, credit decisions about customers and to verify customers’ details;
  1. corresponding with customers by email, SMS, letter, telephone or in any other manner for marketing Truworths’ products and services, unless customers inform Truworths that they prefer not to receive such information or marketing material;
  2. identify or prevent fraud, money laundering;
  3. form a view of customers as individuals and to identify, develop or improve products, that may be of interest to customers;
  1. perform other administrative and operational purposes including the testing of systems;
  2. trace customers’ whereabouts for purposes relating to the agreement with the customer;
  3. recovering any debt customers may owe Truworths;

Full time and part time employees, contract workers, and applicants

  1. verification of candidate’s information during application process;
  2. general matters relating to personnel;
  1. pension fund application and maintenance;
  2. medical aid application and maintenance;
  3. payroll;

Prospective customers:

  1. verifying and updating information available about prospective customers;
  2. pre-scoring;
  1. carry out market research, business and statistical analysis;
  2. comply with Truworths’ regulatory or other obligations in terms of the law or contract.

Vendors / suppliers / other business relationships:

  1. verifying information and performing checks;
  2. all reasonable processing purposes relating to the agreement or business relationship or possible agreement or business relationships between the parties;
  1. comply with Truworths’ regulatory or other obligations in terms of the law or contract;
  2.  

General processing purposes:

 

  1. Categories of data subjects and information relating to them:
    • Customers and prospective customers;
    • Employees, contractors and candidates;
    • Vendors, suppliers, and other business relationships;
    • Persons visiting Truworths' online platforms and website; and
    • Persons whose personal information Truworths collects due to the relationship with Truworths' customers (e.g. references, beneficiary information received from a customer).

General: Truworths processes personal information as defined in POPIA which includes names, identification numbers, location information, online identifiers or one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of a person. Truworths collects various information fields, depending on the reason why the information is needed.

Special personal information: this includes race, biometric behaviour and health information may also be processed, but will only be processed with a data subject's consent or if otherwise permitted under POPIA.

Specific categories of personal information: In addition to personal information and special personal information as outlined above, which may be applicable to all categories of data subjects, the following personal information of the below categories of data subjects is processed by Truworths for the purposes outlined above:

 

Personal information may be supplied to the following recipients in compliance with applicable laws –

 

  1. Transborder flows of personal information:

Truworths may transfer personal information cross border for legitimate business purposes, such as for cloud storage and for billing practices or where Truworths' service providers process personal information cross border in terms of the contract between Truworths and the service provider concerned. All information transfers will comply with POPIA and all other applicable laws.

The following measures are examples of measures that have been implemented to ensure the confidentiality, integrity and availability of the information which is processed by and on behalf of Truworths:

  1. Availability of the Manual [Section 51(3) of the Act]

This Manual is available for inspection at the head offices of Truworths at No. 1 Mostert Street, Cape Town free of charge. Copies are available with the SAHRC, and on Truworths’ website.  The manual will be made available to any person on request and upon the payment of a reasonable fee and will also be made available to the Information Regulator on request.

  1. Fees in respect of private bodies
  1. The fee for a copy of the Manual as contemplated in regulation 9(2)(c) of the Act is R1,10 for every photocopy of an A4-size page or part thereof.
  2. The fees for reproduction referred to in regulation 11(1) are as follows:
    1. For every photocopy of an A4-size page or part thereof: R1,10
    2. For every printed copy of an A4-size page or part thereof held on a computer or in electronic or machine-readable form: R0,75
    3. For a copy in a computer-readable form on -
      1. compact disc: R70,00
    4.  
      1. For a transcription of visual images, for an A4-size page or part thereof: R40,00
      2. For a copy of visual images: R60,00
    5.  
      1. For a transcription of an audio record, for an A4-size page or part thereof: R20,00
      2. For a copy of an audio record: R30,00
  3. The request fee payable by a requester, other than a personal requester, referred to in regulation 11(2) is R50,00
  4. The access fees payable by a requester referred to in regulation 11(3) are as follows:
    1. For every photocopy of an A4-size page or part thereof: R1,10
    2. For every printed copy of an A4-size page or part thereof held on a computer or in electronic or machine-readable form: R0,75
    3. For a copy in a computer-readable form on -
      1. Compact disc: R70,00
      1. For a transcription of visual images, for an A4-size page or part thereof: R40,00
      2. For a copy of visual images: R60,00
      1. For a transcription of an audio record, for an A4-size page or part thereof: R20,00
      2. For a copy of an audio record: R30,00
    4. To search for and prepare the record for disclosure, R30,00 for each hour or part of an hour reasonably required for such search and preparation.
  1. For purposes of section 54(2) of the Act, the following applies:
  2. Six hours as the hours to be exceeded before a deposit is payable; and
  3. one third of the access fee is payable as a deposit by the requester.
  4. The actual postage is payable when a copy of a record must be posted to a requester.

This must be made to the Information Officer of Truworths International. This request must be made to the address, fax number or electronic mail address of Truworths International [s 53(1)].
    • The requester must provide sufficient detail on the request form to enable the Information Officer of Truworths International to identify the record and the requester and/or the right they wish to exercise. The requester should also indicate which form of access is required. The requester should also indicate if any other manner is to be used to inform the requester and state the necessary particulars to be so informed [s53(2)(a) and (b) and (c)].
    • The requester must identify the right that is sought to be exercised or to be protected and provide an explanation of why the requested record is required for the exercise or protection of that right [s53(2)(d)].
    • If a request is made on behalf of another person, the requester must submit proof of the capacity in which the requester is making the request to the satisfaction of the Information Officer of Truworths International [s 53(2)(f)].

  1. Information security measures:

The following measures are examples of measures that have been implemented to ensure the confidentiality, integrity and availability of the information which is processed by and on behalf of Truworths International:

  1. Availability of the manual [Section 51(3) of the Act]

This manual is available for inspection at the head offices of Truworths International at No. 1 Mostert Street, Cape Town free of charge. Copies are available with the SAHRC, and on Truworths’ website.

  1. Fees in respect of private bodies
  1. The fee for a copy of the manual as contemplated in regulation 9(2)(c) of the Act is R1,10 for every photocopy of an A4-size page or part thereof.
  2. The fees for reproduction referred to in regulation 11(1) are as follows:
    1. For every photocopy of an A4-size page or part thereof: R1,10
    2. For every printed copy of an A4-size page or part thereof held on a computer or in electronic or machine-readable form: R0,75
    3. For a copy in a computer-readable form on -
      1. Compact disc: R70,00
    4.  
      1. For a transcription of visual images, for an A4-size page or part thereof: R40,00
      2. For a copy of visual images: R60,00
    5.  
      1. For a transcription of an audio record, for an A4-size page or part thereof: R20,00
      2. For a copy of an audio record: R30,00
  3. The request fee payable by a requester, other than a personal requester, referred to in regulation 11(2) is R50,00
  4. The access fees payable by a requester referred to in regulation 11(3) are as follows:

 

  1. For every photocopy of an A4-size page or part thereof: R1,10
  2. For every printed copy of an A4-size page or part thereof held on a computer or in electronic or machine-readable form: R0,75
  3. For a copy in a computer-readable form on -
    1. compact disc: R70,00
    1. For a transcription of visual images, for an A4-size page or part thereof: R40,00
    2. For a copy of visual images: R60,00
    1. For a transcription of an audio record, for an A4-size page or part thereof: R20,00
    2. For a copy of an audio record: R30,00
  4. To search for and prepare the record for disclosure, R30,00 for each hour or part of an hour reasonably required for such search and preparation.
  1. For purposes of section 54(2) of the Act, the following applies:
    • . Six hours as the hours to be exceeded before a deposit is payable; and
  1. one third of the access fee is payable as a deposit by the requester.
  1. The actual postage is payable when a copy of a record must be posted to a requester.
  2. Prescribed forms (also available at www.sahrc.org.za)
